In so far as ARTICLE VIII of the Cedar Lake Declaration states:
"no building, fence, wall, or other structure shall be commenced or erected within any Lot or within the Common Area, and no exterior addition to or change to or alteration shall be made on any structure or building or improvement located within a Lot or within the Common Area until the plans and specifications showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing as to harmony of external design and location in relation to surrounding structures and topography by the Board or Directors of the Association, or by an Architectural Control Committee", the Association at its 1989 annual general meeting on 15JAN89 unanimously approved as its architectural policy that:
Fences
- No fence shall be erected without the prior written approval of the Architectural Committee.
- Approval is given on an individual basis by the Architectural Committee taking into account: Lot location, size and length of the fence, material, location of the fence, landscaping plans, and purpose.
- If neighbors immediately adjacent to a Lot that is to be fenced object, it is possible the Architectural Committee will not approve the plans. It is suggested that the individual that is requesting to erect a fence contact their neighbors and explain the proposed construction. It will then be the responsibility of the Architectural Committee to contact the same neighbors if there appears to be an objection.
- Fences on lake Lots will not be approved with the possible exception of an area fence close to the house.
- Wooden fences are highly preferable to chain-link fences. On a wooden fence, spaces between the boards are preferable to solid construction. Alternating boards between inside and outside of horizontal runners is better yet.
- Fencing material and installation must conform to a reasonable and acceptable standard of construction, e.g., level, plumb, straight, and aesthetically pleasing to the eye.
- Fencing between two adjoining Lots should be on the Lot line. A survey is recommended.
Boat Docks
- Construction must be rot-resistant material such as CCA-treated yellow pine or redwood.
- Floating docks must use floatation material (bats) that will not readily deteriorate or flake off. Bats made of fused white Styrofoam pellets will not be approved.
- A dock shall not extend into the lake more than 18 feet.
Outbuildings, Storage Sheds, and Gazebos
- Any building that is detached from the dwelling within any lot will NOT be approved.
- Exceptions may be made for small, temporary children's playhouses on an individual basis.
Dog Pens and Dog Runs
- Dog pens and dog runs will not be approved.
- Approval would be considered for the special case of a movable pen or run that is to be used on a temporary basis (30 days or less).
Approval for Construction
Approval for any construction is given by the Architectural Committee and/or Board of Directors. An appeal for review of an unfavorable decision by the Architectural Committee may be made to the Board of Directors.
Approval is given on an individual basis with the best interests of the Association as the overriding consideration. After an individual purchases a Lot, approval cannot be obtained from the Developer, contractor, or real estate agent; that authority lies with the Architectural Committee and the Board of Directors.
The Architectural Committee meets weekly when there is business to discuss. At least one week must be allowed before an approval can be expected.
